What is stability certificate and What are the requirements for Stability certificate based on Indian Health and Safety Legislation?

Answer:

Approval, licensing and registration of factories Sec 6    “Approval of plans” contains requirements of stability certificate.

Stability certificate signed by a competent person with below statement:

I (Competent Person) certify that I have inspected the building/buildings,  the plans of which have been approved by  the Chief inspector of Factories.I  am  of  the   opinion   that   the
building/buildings  which has/have been constructed/reconstructed/extended/taken into use is/are in accordance with the plans approved by the Chief Inspector in his letter  mentioned above.
Building/ Buildings are structurally sound and that its/their stability  will not be endangered by its/their use as factory/part of a factory for   the manufacture of .......... for which the machinery, plant, etc.  installed are intended.



Who is Competent Person?

(4) The person signing the stability certificate shall possess one or other of the following qualifications :
(a) Corporate membership of any of the following institutions :
(i) The Institute of Civil Engineers.
(ii) The Institute of Structural Engineers.
(iii) The Royal Institute of British Architects.
(iv) The Institute of Engineers (India) together with a degree of a recognized Civil Engineering College in India; provided that he has also been for three years in bona fide practice on his own accounts as Chief Assistant of a recognized firm of Civil Engineers, or

(b) Such other qualifications as the Chief Inspector of Factories may approve. 

So, Chief inspector of factory ask occupier to start manufacturing  after stability certificate by a competent person.No manufacturing process shall be carried out in any premises of a factory unless a fresh certificate of stability is obtained from a competent person

Note
1- Stability Certificate is also required when after extension, alteration, repairs or addition of any work of engineering construction or replacement or addition of machinery, plant, etc., and sent to the Chief Inspector.

2- No person except in the case of building occupied by any Government shall be authorized to sign a Certificate of Stability, who is in the employment of the owner or builder of the building in respect of which the certificate is given.

      I certify that I have inspected the building/buildings,  the plans of which have been approved by  the Chief       Inspector in his letter No....  ............ dated ......... and examined the various parts including the foundations       with special reference to the machine, plant etc.,     that   have   been   installed.   I  am  of  the   opinion   that        the  building/buildings  which has/have been constructed/reconstructed/extended/taken into use is/are in
      accordance with the plans approved by the Chief Inspector in his letter  mentioned above, that it is/they are       structurally sound and that its/their stability  will not be endangered by its/their use as factory/part of a factory      for   the manufacture of .......... for which the machinery, plant, etc.  installed are intended.
